Terms of Service

Accounts are created and managed by an adult (18+) parent or legal guardian (the account holder). Children do not create their own accounts; instead, the account holder sets up one or more child profiles within their family account and permits each child’s use of the Service.

• You agree to provide accurate information and to keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account and its profiles.
• You must notify us promptly of any unauthorized use of your account.

The account holder must be at least 18 years old and have the legal authority to agree to these Terms on behalf of themselves and any child they add. By adding a child profile, you represent that you are that child’s parent or legal guardian and that you consent to the collection and use of the child’s information as described in our Privacy Policy. You are responsible for supervising your child’s use of the Service.

You agree not to, and not to permit anyone to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to disable, bypass, or interfere with safety features, content filters, or usage limits;
• Reverse engineer, scrape, or use automated means to access the Service except as expressly permitted;
• Upload or transmit malicious code, or attempt to gain unauthorized access to our systems or other users’ data;
• Resell, sublicense, or commercially exploit the Service without our written permission;
• Use the Service to generate or solicit content that is harmful, harassing, or inappropriate.

BrosLearn uses artificial intelligence to generate and deliver tutoring content, including lessons, explanations, quizzes, and interactive chat. AI-generated content may occasionally be inaccurate, incomplete, or not appropriate for every learner.

• The Service is a supplement to, not a replacement for, formal education, professional instruction, or a qualified educator.
• Content does not constitute professional, medical, legal, psychological, or financial advice.
• We encourage account holders to review the material their children engage with and to verify important information.

The Service, including its software, design, curriculum structure, and original content, is owned by BrosLearn or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial, educational purposes for your family.

You retain ownership of any content you or your child submit (such as answers or messages). You grant us a limited license to process that content solely to operate, secure, and improve the Service as described in the Privacy Policy.

Some features may be offered free of charge and others may require a paid subscription. If you purchase a subscription, you authorize us (or our payment processor) to charge the applicable fees to your payment method on a recurring basis until you cancel. Fees are billed in advance and are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period. We may change pricing with reasonable advance notice.

The Service relies on third-party providers (for example, for authentication, hosting, storage, and AI processing). Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services we do not control.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Upon termination, your right to use the Service ceases; sections intended to survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate.

To the maximum extent permitted by law, BrosLearn and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You agree to indemnify and hold harmless BrosLearn and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or applicable law.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which BrosLearn is established, without regard to conflict-of-laws principles, except where mandatory consumer-protection laws of your place of residence apply.
